The monograph is one of the first in domestic jurisprudence comprehensive studies of the administrative and legal status of a state body that carries out state regulation in the energy sector in Ukraine in the context of European integration. The monograph systematically highlights the theoretical and legal aspects of state regulation in the energy sector, analyzes the requirements of EU legislation regarding the institutional support of state regulation in the energy sector, the main legal problems of the administrative and legal status of the energy regulator in Ukraine were investigated, and proposals were formulated for its improvement, taking into account the requirements of EU legislation.
Doctor of Law thesis "State Regulation in the Energy Sector: administrative and legal aspects" defended in 2016.
The Administrative Law issue on the development of the complex State Energy Regulation Concept in Ukraine has been resolved in the thesis.
The theoretically-legal framework of the State Energy Regulation has been presented. The correlation between the Energy Government and Energy Regulation was explored, the notion and the main features of the Energy Regulator were developed, the legal dimensions of its independence were discovered, the legal issues of the encouragement of energy security and the right to access to modern energy services in the context of the State Energy Regulation were analysed.
It is concluded that the independence of the regulator in the system of public authorities should be encouraged by the special place in the system of public bodies (ideally – by separation from all traditional branches of power – legislative, executive, and judicial), special (arm-length) relations with other public authorities, the special procedure of the establishment, reorganization and liquidation of such authorities, as well as of the appointment and dismissal of the heads and the members of the collegial managerial bodies.
In order to stress the humanitarian dimension the civil energy security has been separated among the range of the main types of energy security, together with global energy security, national (state) energy security, and regional energy security.
It is recommended to stipulate the right to access to modern energy services as a separate Human Right or as a separate part of the right to adequate standard of living both at international and national levels (primarily in the constitutions).
The main requirements of the EU legislation on the institutional encouragement of energy regulation, as well as the experience of the EU Member States on its implementation were explored.
The main stages of the development of the legislation of Ukraine on the institutional encouragement of energy regulation were defined, the issues of the organizationally-legal form of the energy regulatory authority in Ukraine were analysed, its place in the system of public authorities in Ukraine was defined, legal issues of its human and financial resources were explored.
Based on the research conducted the range of scientifically proven conclusions for the further development of the Administrative Law Science, as well as recommendations on enhancement of the legislation of Ukraine in the sphere of energy regulation were developed.
It is recommended to amend the Constitution of Ukraine with the provisions on the legal status of national regulatory commissions, to develop the special law of Ukraine on National Regulatory Commissions. The sectoral peculiarities of a legal status of the energy regulatory commission should be defined by laws that regulate certain energy spheres. It is suggested that the national regulatory commissions should be established and liquidated exclusively on the basis of the special laws that regulate the certain fields of economy, including energy sector. It is concluded that the legal framework of such bodies should be defined by the Constitution and laws of Ukraine. Based on the main requirements of the EU legislation (in particular, on the requirements on national regulatory authorities in the energy sector), as well as on the experience of the EU Member States on its implementation and the system of public authorities in Ukraine it is suggested to stipulate that the head of a national regulatory commission should be appointed and dismissed by the Verkhovna Rada of Ukraine upon the proposal of the President of Ukraine; the members of such bodies – in equal parts by the Verkhovna Rada of Ukraine and by the President of Ukraine. It is proved that national regulatory commissions should be accountable to the Verkhovna Rada of Ukraine and to the President of Ukraine. It is recommended to grant the right of legislative initiative to the national regulatory commissions.

The aims of this research are: to explore the connection between the right to access to modern energy services and children’s rights, as stipulated by the Convention on the Rights of the Child; to analyze how the rights of children are addressed in the energy policy and law of certain EU Member States and Ukraine; and to develop recommendations on how to make national energy policy and law more child-sensitive. To achieve these goals, the following objectives were set: 1) to explore the correlation between the right to access to modern energy services and children’s rights under the Convention on the Rights of the Child; 2) to analyze the Integrated National Energy and Climate Plans (NECPs) of certain EU Member States in order to find out how children’s rights are addressed in policy and law and to identify the most common practices; 3) to analyze the current and prospective legislation in Ukraine that relates to children’s rights to modern energy services; and 4) to develop recommendations on how to make national energy policy and law more child-sensitive. The main results of this research are: 1) access to modern energy services is vital for children’s enjoyment of their rights (e.g., the right to life, survival, and development, the right to health, the right to education, the right to adequate housing, the right to be protected from any form of violence, neglect, or negligence, and the right to be heard); 2) states shall specifically address issues of children’s rights (in particular, by tackling energy inequality, considering the risks for the concrete category of children, targeting certain rights of children that depend on access to modern energy services, and introducing concrete actions and outcome indicators) in the strategic documents and legal acts that relate to universal access to modern energy services; 3) the social protection of low-income families with children in the form of discounts for energy bills and state support for the implementation of energy efficiency improvement measures in residential buildings (as mechanisms for tackling energy poverty), the encouragement of the energy renovation of pre-school and school buildings, and the development of special educational tools on sustainable energy for pupils are considered the most common practices in certain EU Member States; 4) whilst Ukrainian energy policy and law includes some instruments that relate to children’s rights as energy consumers, it lacks a complete approach; and 5) the energy policy and law of Ukraine should specifically address children’s rights as energy consumers, specifically those based on the common approaches used in EU Member States, in order to consider the peculiarities of children’s energy needs.

This paper aims at analysing the policy and legal framework of joint study programmes in Eastern Partnership countries (EaP countries) in frames of the standards of the European Higher Education Area and providing the recommendations on its enhancement. It is concluded that the internationalization of higher education has been considered as one of the critical priorities of the educational policy in EaP countries. However, more emphasis on the role of joint study programmes is needed. The level of specification of legislative requirements on joint study programmes in EaP countries differs. The educational laws in Georgia, Moldova include special provisions devoted to joint study programmes, in Ukraine – basic framework, including the possibility to establish joint study programmes and awarding the joint degrees, while respective legislation in Armenia, Azerbaijan, and Belarus – just general provisions regarding the international cooperation of higher educational institutions. It is suggested to implement the European Approach for Quality Assurance of Joint Programmes in national laws and regulations in EaP countries, first of all, in part of the definition of joint study programmes and the recognition of the accreditation decisions of foreign quality assurance agencies.

In this paper, the EU legislation regarding the cybersecurity protection in the energy sector has been analysed, the best practices on cybersecurity strategies in the energy sector of certain EU Member States have been detected, the recent developments of Ukrainian legislation in this field have been explored, the recommendations regarding improvement of organizational and legal mechanisms of cybersecurity protection of consumers in the energy sector have been elaborated.

This paper aims at the exploring the issues of the legal regulation of alternative means for administrative disputes resolution in Ukraine in frames of European integration. The importance of alternative dispute resolution in the field of administrative legal relations has been emphasised by the Committee of Ministers of the Council of Europe in a number of its recommendations. Alternative means have been introduced in administrative procedure and administrative justice in some European countries, including Ukraine. However, the ADR mechanisms in administrative legal relations still are not widely used primarily because of the lack of the clear legal regulation. In this paper, the core problems related to the use of alternative means for dispute resolution in administrative procedure and administrative justice have been identified and recommendations on enhancement of legal regulation of certain instruments in Ukraine have been provided based on the European approaches and the best practices of the selected states – members of the Council of Europe.

Planning is an essential tool of public governance. Plans are among the key instruments of public administration. The energy sector is a strategic sector in all countries. Effective energy planning is crucial for the sustainable development and functioning of each country’s energy sector, as well as other sectors of the economy and the entire state. Energy policy is an important area of European Union (EU) policy, and plans are among the key instruments of EU institutions. However, plans as tools of public administration in general and in the energy sector in particular have not yet been sufficiently researched, which may cause problems in their practical application. This paper aims to explore the peculiarities of plans as instruments of public administration in the energy sector at the EU level and at the national level in the Slovak Republic as an EU Member State and Ukraine as an EU candidate country. Based on the analysis conducted, theoretical generalisations about plans as instruments of public administration have been made (e.g. a classification of plans is provided). Furthermore, recommendations on enhancing legal regulation of energy planning both at the EU level and the national level in the Slovak Republic and Ukraine have been developed.

Grant project 09I03-03-V01-00150 of the Government Office of the Slovak Republic based on the concluded Agreement No. 44/2023 on the provision of funds from the mechanism to support recovery and resilience.

The project was aimed at the research on administrative law issues with a special focus on administrative energy law.

The project resulted in a comprehensive de lege ferenda proposal in the field of land consolidation in Slovakia, which was provided to the project stakeholders. The project’s publications, including a monograph, scientific articles, and conference papers, can serve as a basis for further research and practice at both the national and international levels.
Role in the project: member of the research team. In frames of the project contributed to the publication of the monograph and the research paper.
Research project APVV-24-0543 Energy Performance of Buildings in the Slovak Republic: Enhancement of the Organizational and Legal Framework in the Light of the New EU Requirements
Duration of the project: 2025-2029
The primary objective of the project is to analyse the current legal framework de lege lata regarding EPB and subsequently develop legislative proposals de lege ferenda that will contribute to improving the organizational and legal framework in this area, taking into account the EU legal requirements and the best practices from the selected European countries. A fundamental role of universities is to contribute to solving societal challenges, such as EPB. The expected outcome of the proposed project will be the development of de lege ferenda proposals and comprehensive analyses that will help improve the situation in this sector.
