Scientific research is the result of an expert examination of the author within the possibility of out-of-court settlement of disputes arising from BtC relations. The scientific article analyzes the shortcomings in the decision-making activity of courts in the acceptance of arbitration clauses in the Slovak Republic and other states within the EU, the results (correct application of standards and relevant case law of the Court of Justice) are transferable within other EU states.

The publication is a systematic analysis of the application of EU law and in an innovative way links EU institutional law with its decision-making processes. It analyzes and compares the basic principles of application of individual sources of EU law, while these results are fully applicable in other EU countries (for example, the publication is used by academics and researchers in the Czech Republic). At the same time, an innovative way of research consists in a case-by-case interpretation of the application of EU law with an analysis of more than 300 judgements of the Court of Justice of the EU.


There are 21 responses to the publication in the CREPČ across the legal branches, ie. the output is fundamental to the examination of EU legal norms within individual legal orders.

The scientific output is a critical analysis of the Court of Justice's decision-making in the dynamically developing area of judicial cooperation in EU civil matters, and the research results in the determination of the limits of the Court's intervention in the decision-making of the general courts of the Member States. This approach of the author is also implemented by other academics within the Department (Peter Lysina), as well as other departments of international law in the Slovak Republic (e.g. Miloš Levrinc).

One of the most recent scientific outputs is a critical analysis of the decision-making activity of Slovak courts in the field of application of European and national law. The paper offers a solution to a challenging and protracted litigation agenda in energy law with an impact on the state budget and the budget of private companies worth several million euros. Recent case law confirms the conclusions drawn in the research summarised in the published paper.

The scientific output represented a breakthrough in the critique of the legislative activity of the National Council of the Slovak Republic and the way of the (unconstitutional) procedure of amending legal acts in the Slovak Republic, on the example of a similar ban in the Czech Republic. The author systematizes and transposes knowledge and case law from the Czech Republic into the legal system of the Slovak Republic.

The main objective of the project was to carry out research into the application of European Union law in the field of judicial cooperation in civil and commercial matters. The secondary goal of the project was to monitor the development of decision-making practice in Slovak courts. Another secondary goal of the project was to use the outputs of the project in the higher education process. During the project, a database of more than 120 annotated court decisions was created - the Court of Justice of the EU, the courts of the Slovak Republic, the ECtHR and the courts of other EU member states. The members of the research team created almost 100 electronic documents, t. j. documents issued in computer - readable form only; and directly in project solutions that are part of further research and education.

Since September 2007 prof. Slašťan also served as a permanent member of the pedagogical staff (Department of European and International, Constitutional Law and Foreign Languages) of the Judicial Academy of the Slovak Republic, from 2009 to September 2010 as its head of the Department of International and European Law, Initial Training and Social Sciences. He was responsible for training and lecturing for judges and prosecutors, including the initial training for judicial officers, judicial trainees and legal trainees in the prosecutor's office. He is currently a member of the Council of the Judicial Academy of the Slovak Republic and co-responsible for the initial and continuous training of judges, prosecutors and senior court officials. As an external member of the pedagogical staff of the Academy of Justice of the Slovak Republic, he actively lectures to judges and prosecutors abroad (in 2013, for example, in Poland). Since February 2013, it has also been engaged in the performance of expert activities, the submission of expert opinions, explanations, expert opinions and opinions pursuant to Act no. 382/2004 Coll. on experts, interpreters and translators as an expert in the field 33 00 00 Legal relations to foreign countries (sector 33 01 00 Private and procedural international law, 33 03 00 European law). In 2012, he was elected by the Judicial Council of the Slovak Republic on the proposal of the National Council of the Slovak Republic as a member of the Disciplinary Chamber of the Supreme Court of the Slovak Republic. He also served as a member of selection committees to fill the positions of judges of district courts, regional courts and the Supreme Court of the Slovak Republic. Prof. Slašťan was a member and evaluated the last three candidates in the habilitation procedure organized by the Faculty of Law of Masaryk University in Brno (doc. Sehnálek, doc. Valdhans, doc. Drličková). From June 17, 2024, he became an advisor to the President of the Slovak Republic for legal issues.
