Financial assistance provision in Slovak legal environment (M&A Law),

Financial assistance has long been an area of intensive debate, particularly in regard to

its provision by companies. Among Member States of the European Union, views

differ on the eligibility of financial assistance, as is evident in the support for national

law provisions on financial assistance rules. This article examines the issue more

closely, focusing on the relevant legal provisions in Slovakia and how they compare

with those in the Czech Republic

The development of the information society has not only made life easier, but also

entailed new types of threat. Cyber risks are such an example, concerning mainly

those companies – including financial institutions – that handle large volumes of data

and have to process this data as part of their business. Standard insurance products

typically do not cover cyber risks, except sometimes as part of listed exemptions. This

has created a gap in the market, which is now being filled by a new line of insurance

business – cyber risk insurance. As this insurance line gains in importance, it will give

rise to new and cheaper products, while lawmakers will come under pressure to

impose limits on its scope. Cyber risk is becoming increasingly important since the

effects of a cyber attack can be much more serious than those of a single terrorist

attack on hardware (where damage is confined to immovable property).

Regulations creating new supervisory architecture in the EU, that have also anchored

the creation of the European Supervisory Authorities, lay down a duty for the

European Commission to submit a report on functioning of these authorities in 2014.

More than three years after the establishment of the ESAs in January 2011 the

Commission submits an evaluation report on them to the European Parliament and the

Council. The first part of this article aims to summarise the report's most important

parts, findings and plans for further path of the European Supervisory Authorities in

the medium term, whereas its second part offers the authors' views on the future

functioning of these authorities

The article deals with the area of compulsory contractual third party liability

insurance for heavy machinery (especially forklifts), which normally do not

operate on roads, however – given their size – they could, similarly to an

ordinary motor vehicle, potentially cause property or health damage to other

persons. The case law of Slovak courts also shows that, occasionally, this type

of machinery ends up in collisions, which may also lead to insurance claims. It

should be noted in this context that decisions taken by general courts in the

Slovak Republic are quite inconsistent and for the time being there is no

unifying opinion of the Supreme Court of the Slovak Republic in this matter
