The project summary: The submitted research project consists of interdisciplinary and scientific analysis of the selected crimes, which protect the economical and legal relationship's participants, in particular, but not limited to creditors. These crimes can not be scientifically analysed without depth analysis of the related legislation like financial law, administrative law, nor without the scientific analysis of economical and legal environment, where this criminal conduct occurs. Therefore it is important, that the project will be based on detailed economical, sociological and legal, even criminological analysis. The project aims to analyse, what effect does the current legislation have, identify its weaknesses regarding the reality and to propose a de lege ferenda legislation, which would eliminate these weaknesses.

Innovative forms of funds pooling and their transfer, project VEGA 1/0440/17, 2017-2019, project leader

The project summary: The project's essence is to critically evaluate readiness of the Slovak/EU legislation to selected new forms of funds pooling and their transfer, and identify potential gaps in the Slovak legal environment and the EU harmonization potential. In this sense it will be necessary to analyze the pros and cons of the new legal regulation, or its leveling and forming in this area. Over the course of the research it will be necessary to analyze the current status of the innovative forms of funds pooling creation and their transfers in selected countries of the world with an emphasis on the EU member states. The goal of the project is to propose their application in the context of the Slovak legal framework and propose their prospective economic potential. Mapping of the applicability of the legislation, opinions and recommendations of the regulatory bodies and agencies of the EU/Slovakia, as well as the case law, in comparison with the identified regulatory risks would allow us to create risk mitigation proposals.

Financial innovations as a determinant of current and anticipated regulation of the financial market (challenges and risks), project VEGA 1/0212/23, 2023-2025, project leader

The project summary: The project is focused on analysis of financial innovations and on identification of emerging financial innovations/business models on the financial market that are representing constant challenge for financial law regulation and its application in practice. The selected innovative business models will be examined from the perspective of application of the existing regulation (interdisciplinary examination of private law and public law); potential need for new regulation with an emphasis on resolving the conflict between private law and public law sector regulation in the financial market; the need to regulate potential unauthorized business, respectively exploring the possibilities of administrative sanctions under the existing regulation; tax aspects (use of financial innovations in order to prevent tax frauds and evasions) and the abuse of financial innovations from the perspective of protection of the financial consumer and for money laundering and terrorist financing and the economic perspective.
